STOCK ATTRIBUTION
Stock photo attribution / copyright?
An ad agency wants to pay me for one-time usage of a photo of mine for a magazine. My question is whether they need to put "photo copyright John Smith (my name)" anywhere in the ad or on or next to the photo? I would like my name on the photo and would consider giving them a better price if it was on there. But is this standard practice or is it my right as the copyright owner?
UK only in this answer - but I believe US have the same or similar.
Section 77-78 of the copyright act here - http://www.opsi.gov.uk/acts/acts1988/ukpga_19880048_en_4#pt1-ch4-pb1-l1g77
state that the author has the right to be identified as the author when a copyright work is displayed/published.
When being published in an ad or the like then you need to discuss this with the ad agency.
It is possible that giving you a credit actually on the ad would not be possible or good for the ad itself.
In the case of pictures being featured in a magazine/book often the attribution will be on a totally seperate page.
This is something you can relatively easily sort with the agency.
